Calcutta HC grants bail to 2 under trial for murder on the ground of right to life under Article 21

  The accused, Munna Dhali and Nabu Dhali, have been incarcerated for over 12 years, awaiting completion of trial in a 2012 murder case.

The Calcutta High Court granted bail to a murder accused, citing Article 21 of the Indian Constitution, due to an inordinate delay in the trial process. The accused, who has been in custody since 2018, saw no progress in his case as the trial court failed to frame charges. Justice Bibek Chaudhuri emphasized that the right to a speedy trial is a fundamental right under Article 21, and the prolonged detention without trial advancement violated this right. The court noted that the accused had been in jail for over five years without any significant steps taken in the judicial process, leading to the decision to grant bail.
